In 2021, the FDA took a major step in clarifying its stance on the regulation of AI and machine learning (ML) in medical devices with an updated action plan. This plan addresses the challenges surrounding software-as-a-medical-device (SaMD) and offers a roadmap for how the FDA intends to approach AI-powered medical technologies. As AI and ML continue to evolve, the FDA's efforts to regulate AI-based medical devices are also expanding, focusing on maintaining safety while enabling innovation.
According to FDA guidelines in the US, AI software programmes and devices are most likely to fall under Class 3.
Class 3 is defined as high risk. This represents ~10% of medical devices on the market and is the primary category where artificial intelligent systems fall into. They can pose serious threats to patients if they malfunction.
Whilst most AI software programmes and devices serve to assist medical professionals, it’s difficult to say whether these devices will override the judgement of health professionals.
This leads us onto the next hurdle: Patient and provider trust. Even if the FDA does approve these medical devices, will they be trusted?
AI is becoming more common in various industries, from finance to logistics, but healthcare is unique in the stakes it carries. AI-powered systems that make treatment recommendations can be perceived as both a benefit and a risk. For example, AI can aid in disease detection and decision support, but it is also seen as unfamiliar and sometimes "black-box" technology.
Recent surveys, such as one conducted by Intel and Convergys Analytics, show that 91% of healthcare decision-makers see the potential benefits of AI, including improvements in quality of care and operational efficiency. However, 54% express concerns about AI potentially compromising patient safety.
While AI’s promises are huge—such as IBM’s Watson for Oncology, which aimed to revolutionize cancer treatment—the technology has faced criticism for failing to deliver on its initial promises. Investigations have shown that Watson sometimes struggles to differentiate between cancer types and provide actionable, contextually accurate recommendations. However, in certain use cases, such as diagnostic imaging (e.g., ultrasounds or CT scans), privacy remains a key concern. Moreover, as healthcare data becomes a prime target for cybercriminals, AI's growing role in cybersecurity is crucial. AI-enabled systems are already being used to monitor and identify cybersecurity threats in real time, detecting vulnerabilities more effectively than traditional methods.
The rise of cyberattacks also underscores the need for robust, AI-driven security solutions. While AI can improve security by detecting threats and protecting data, human oversight is still essential to address context-specific issues that AI may not be able to process.
AI in healthcare is still in its early stages, and we are just beginning to scratch the surface of its potential. AI’s ability to analyze massive datasets, detect complex patterns, and assist in clinical decision-making is unparalleled, making it a powerful tool in the healthcare space. Yet, for AI to be successfully integrated into mainstream healthcare, trust—must be earned.
